Acceptable Use Policy
Last updated:
This Acceptable Use Policy ("AUP") describes what you may not do with Sendoka. It is part of our Terms of Service and applies to every account holder, organization member and API key, and to every tenant a platform customer sends on behalf of. Email and SMS only work for anyone if mailbox providers and carriers trust the infrastructure carrying them, so we enforce this policy actively.
1. Consent is required
- Send only to people who have asked to hear from you, or with whom you have a relationship that the law treats as permission for the kind of message you are sending. Purchased, rented, scraped, harvested, appended or shared lists are prohibited, as is sending to addresses generated by guessing.
- Marketing SMS requires prior express written consent from each recipient under the US Telephone Consumer Protection Act (TCPA) and equivalent rules elsewhere. Consent must be specific to you, not bundled as a condition of purchase, and recorded with the time, source and language shown. Keep that evidence and provide it to us on request.
- Honor opt-outs immediately and permanently. Every marketing email must carry a working unsubscribe mechanism — Sendoka adds a one-click
List-Unsubscribeto broadcast mail — and identify the sender and a valid postal address as CAN-SPAM requires. SMS programs must honor STOP and similar keywords and respond to HELP. Do not remove, rename or work around the suppression lists Sendoka maintains. - Respect time-of-day rules. Marketing SMS must not be sent at hours the recipient's local law forbids; audience SMS blasts honor your organization's quiet-hours setting, which you must configure to match the rules that apply to you.
2. Prohibited content and activity
You may not use Sendoka to send, link to, or facilitate:
- Spam — unsolicited bulk or commercial messages, or messages with misleading headers, sender names, subject lines or reply-to addresses.
- Phishing and fraud — messages that impersonate another person, company, bank or government body, harvest credentials or payment details, deliver malware, or promote scams, fake prizes, advance-fee schemes, or deceptive debt relief.
- Illegal goods and services, including controlled substances, counterfeit goods, unlicensed gambling, weapons sales that violate law, and anything that infringes intellectual property or privacy rights.
- Harmful content — sexual content involving minors (reported to the authorities), non-consensual intimate imagery, harassment, threats, hate speech, or content that incites violence.
- High-risk financial offers — payday loans, high-interest or third-party lending, debt collection without the required disclosures, cryptocurrency or investment promotions, and get-rich-quick or multi-level-marketing schemes.
- Lead generation or affiliate traffic where consent was collected by someone else, or messages whose content you did not author and cannot vouch for.
SMS: SHAFT and carrier-restricted content
US carriers prohibit or restrict SMS about Sex, Hate, Alcohol, Firearms and Tobacco (including vaping), as well as cannabis and CBD. Do not send such content by SMS unless the campaign was registered and approved for it and includes the age-gating carriers require. Carriers may block, filter or fine messages that breach their codes of conduct regardless of our approval, and you are responsible for any fines passed through to us as a result.
3. Senders and registration
- Send email only from domains you control and have verified in Sendoka, with accurate authentication records. The sandbox sender is for testing with your own team: it reaches only your organization members' verified addresses, at most 100 recipients a day, and never broadcasts.
- US application-to-person SMS from long codes requires A2P 10DLC brand and campaign registration; toll-free numbers require verification; messages to India require DLT registration of the entity, header and template. Register truthfully — your actual business, real use case, real sample messages, and working privacy-policy and terms URLs — and send only what you registered.
- Use alphanumeric sender IDs only where the destination country permits them and only for names you are entitled to use. Do not rotate numbers or sender IDs to evade filtering ("snowshoeing").
- Do not send to countries you have not enabled, and do not use the Service for SMS traffic designed to generate termination fees (artificially inflated traffic or "SMS pumping").
4. Sending quality
Keep bounce and complaint rates within the thresholds our providers set. As a guide, an email bounce rate above 5% or a spam-complaint rate above 0.1% is a warning sign and may lead to review or suspension, and SMS opt-out or carrier filtering spikes are treated the same way. Remove addresses and numbers that bounce, and do not re-send to anyone on a suppression list.
5. Security and the platform
You may not:
- probe, scan or test the vulnerability of the Service without permission — responsible disclosure is welcome at security@sendoka.com (see our Security page);
- access accounts, data or API keys that are not yours, or share your API keys outside your organization;
- interfere with the Service, overload it, or circumvent rate limits, usage or spend caps, sandbox restrictions, or test-mode separation;
- create multiple accounts or organizations to evade limits, a suspension, or free-plan allowances;
- resell the Service except through platform mode as documented.
6. Enforcement
We may investigate suspected violations, including by reviewing message metadata and content, and may ask you for evidence of consent or registration. Depending on severity, we may refuse individual messages, disable a sending domain, number or API key, restrict features, or suspend your organization — refusing all API requests and holding scheduled messages — with or without prior notice, and terminate your account for serious or repeated violations, as set out in the Terms. Carriers, registries and mailbox providers may take their own action independently. We may report illegal activity to law enforcement.
7. Reporting abuse
If you received a message sent through Sendoka that you did not ask for, or you believe this policy has been violated, email legal@sendoka.com with the full message, including headers for email or the sending number and time for SMS. Using the unsubscribe link in an email should opt you out of that sender, and SMS programs must honor STOP; replying STOP should opt you out — if either does not, tell us in your report.
